Disability Law: Providing Accommodations for Disabled Individuals

Having a disability is a tough experience, especially if you have been nursing it for years. However, there are disabled individuals who still have the determination to apply for a job and go on with their daily lives. Such people are admirable and should be the role models of other individuals with disabilities.
Unfortunately, some people discriminate against individuals with disabilities. They assume that their health conditions would hinder them from performing well at work, in school, and in everything they do. Good thing there are federal and state laws that prohibit disability discrimination in society.
The Americans with Disabilities Act (ADA) is a disability law that promotes the welfare of people with impaired body functions. It discourages and condemns unfair treatment between disabled individuals and people who do not have impairments. The following are some ADA policies that everyone should follow:
• In companies, employees with disabilities should be given reasonable accommodations to assist them in performing their work. For instance, a deaf employee may be given a hearing aid to facilitate his performance at work.
• Accommodations in public transport and telecommunications should also be implemented for disabled people. There should be assigned areas in bus stops and public transport vehicles for individuals with health conditions and physical impairments.
• In schools and universities, students with impairments should have learning accommodations. Seats and classrooms should remain conducive to learning even if there are disabled students around.
• Mandatory medical exams should not be allowed in job interviews unless they are required for the position. For instance, if the job is a gym instructor, physical examinations are obviously essential.
• Failure to be promoted or decrease in salary because of the disability. If the salary or position of a disabled employee remains low while his colleagues get higher pay, it may be considered disability discrimination.
As stated under ADA, people who would not observe its policies would face legal charges. If they were proven to have discriminated against or they failed to provide accommodations to disabled individuals, they would be required to pay for the damages.

You should be able to prove that the defendant has breached your disability rights. In order to do this, direct or circumstantial evidence and witnesses are important to prove your claim.
