Most marriages in this country come to an end in the most undesirable ways. When most such marriages end in a court of law, the information pertaining to the divorce is made available to the public. Since, divorce records like all other records are property of the government and since such information are deemed public, they are definitely accessible by any citizen of that country.
However, there are certain conditions when a particular divorce record may not be released for public eyes, thus making it look like the divorce never took place. Such divorce records that are not made public are considered to be federal property and are protected. The reasons why such records are protected could be myriad in nature. At times, information from such records is federally protected when the nature of the information is very sensitive. There are some cases where federal witnesses who are a part of the witness protection program had to intervene in the actual divorce proceeding. At times, a person who had come on the witness stand would have been given federal protection because of which the records were actually protected.
If you have been thinking that such information can not be accessed, then you sure have been misinformed. These may not be documents that are available for everybody, but if you have a very valid reason, then you sure can approach a court of law to have the information released to you.
You would also need to remember that based on the intensity of your request, only information that are relevant to your plea shall be disclosed to you. If these divorce records are hidden or protected, then you would not be able to get a list of the witnesses and the actual divorce proceeding.
The judge who looks into your plea would have to be satisfied about the reason that you have stated grant permission. Once the necessary permission is granted, the information that you are looking would be sent to you. In the reasons mentioned if you have stated that you are doing a background check for your marriage with the person in question then only a copy of the divorce certificate would be sent to you. However, the person you are marrying has a domestic violence charge or an abuse charge, then such information shall also be sent to you but none other.
